Laser Welding Machines Export to US vs EU: Comparative Analysis of FDA and CE Certification Requirements

2026-10-30 Industry News

Laser welding machines are high-power industrial laser devices, generally classified as Class 3B or Class 4 laser products. For overseas export, compliance audits focus not merely on product build quality, but on mandatory market access requirements centred on laser radiation safety.

However, the regulatory philosophies of the United States and the European Union differ fundamentally. The US regime centres on FDA radiation safety registration and ongoing compliance maintenance, while the EU system requires coordinated compliance under multiple directives for CE marking, integrating machinery safety requirements.

01 Export to the United States: FDA Radiation Safety Control as the Core

Laser welding machines entering the US market fall under mandatory regulation by the Center for Devices and Radiological Health (CDRH), part of the US Food and Drug Administration (FDA).

Key point: FDA does NOT issue certification certificatesMany manufacturers mistakenly believe FDA approval delivers a formal certificate. In reality, upon successful review, FDA issues an Accession Number, which serves as the primary legal reference for customs clearance and commercial sales.

Four Mandatory Compliance Steps

  • Determine laser classification: Based on output power and wavelength, industrial welding machines are mostly Class 4, subject to the strictest protection and labelling requirements.

  • Conduct laboratory testing: Perform radiation safety testing by an accredited laboratory in accordance with 21 CFR 1040.10 (or IEC 60825-1).

  • Complete FDA registration: Submit Laser Product Report (Form 2877), complete establishment registration to obtain an FEI number, and secure the Accession Number after product listing.

  • Compliance labelling & user manuals: Products must bear marking stating “Complies with 21 CFR 1040.10”, laser class identifier, warning labels and English-language safety instructions.

Common Pitfall: Ongoing Compliance Obligations

FDA registration is not a one-time task. Manufacturers must maintain continuous obligations as listed below:

  • Annual report submission: Due between September 1 and October 1 each year.

  • Establishment annual fee renewal: Renewal window from October 1 to December 31 annually.

  • Change notification: Notify FDA within 30 working days if safety-critical components such as laser cavities, optical lenses or protective enclosures are modified.

  • Appoint a US Agent: Missing or ineffective US Agent representation will directly result in application rejection.

02 Export to the EU: Multi-Directive Compliance for CE Marking

Laser welding machines placed on the EU market must satisfy overlapping requirements of multiple directives; compliance cannot be achieved by a single test alone.

Four Core Directives

  • Machinery Directive 2006/42/EC (to be replaced by the new Machinery Regulation (EU) 2023/1230 effective January 2027)

  • Low Voltage Directive (LVD)

  • Electromagnetic Compatibility Directive (EMC)

  • RoHS Directive (Restriction of Hazardous Substances)

Dual Focus: Laser Safety & Machinery Safety

  • EN 60825-1 (core laser safety standard): Current valid version: 2014+A11:2021. It mandates that Class 4 equipment be fitted with protective housings and interlocks, remote interlock connectors, key-operated controls, beam stops and emission indicators.

  • EN ISO 11553-1 (standard specific to laser processing machinery): Governs overall machine safety. Even if the internal laser source is Class 4, integrated enclosure protection and functional safety design (per ISO 13849) must ensure operators are only exposed to Class 1 level radiation under normal operation. EN ISO 11553-3 also specifies noise measurement requirements.

Conformity Assessment Route

Class 4 laser welding machines are high-risk equipment. Self-declaration alone is generally not permitted. A Notified Body (NB) based in the EU must conduct an EC type-examination before CE marking can be affixed. Technical documentation shall be retained for at least 10 years for inspection.

03 Compliance Recommendations for Manufacturers

Given the divergent regulatory frameworks on both markets, it is advised to embed compliance requirements at the product design phase:

  • US market: Confirm laser classification at an early stage and build an internal annual compliance calendar to guarantee timely report submission and fee renewal.

  • EU market: Carry out machine design guided by EN ISO 11553-1, and schedule Notified Body reviews well in advance.

Optimal strategy: Select a testing laboratory holding FDA-recognised capabilities together with established partnerships with EU Notified Bodies. Basic safety tests can be completed in one batch, with separate applications submitted for US and EU markets, greatly cutting down lead time and total costs.

04 Our Compliance Services

As a professional third-party laser testing laboratory, we provide full compliance services for laser welding machine export:

  • US FDA registration: Full testing against 21 CFR 1040.10, Form 2877 filing, US Agent coordination and annual compliance maintenance guidance.

  • EU CE certification: EN 60825-1 testing, EN ISO 11553 series assessment, technical file compilation and Notified Body liaison.

  • Standard coverage: Testing services also available to IEC 60825-1, GB/T 7247.1 and other domestic & international standards.

  • End-to-end project management: From pre-testing, non-conformity rectification support to final report issuance, one-stop service to help your products clear customs and enter global markets.
