Laser Welding Machine Exports to the U.S. and EU: Key Certification Differences

2026-10-29 Industry News

Laser welding machines face significantly different certification requirements when exported to the U.S. and the EU. The core difference lies in the fact that the U.S. focuses on FDA radiation safety registration and annual maintenance obligations, while the EU emphasises multi-directive coordination and Machinery Directive integration under the CE mark. This article first clarifies the fundamental differences in regulatory logic between the two regions, then breaks down the mandatory certification items, technical standards, and process key points separately, and finally provides compliance pathway recommendations for manufacturers.

I. Introduction

Laser welding machines are high-power industrial laser equipment (typically Class 3B or Class 4). Their export compliance is not a single "quality certification" but a multi-dimensional market access system centred on laser radiation safety, with electrical and mechanical safety layered on top. The U.S. and EU regulatory frameworks follow different logic, and manufacturers must address them separately – they cannot be mixed.

II. Laser Welding Machine Exports to the U.S.: FDA Radiation Safety Control as the Core

1. Competent Authority and Regulatory Basis

  • The FDA CDRH (Center for Devices and Radiological Health) exercises mandatory control over laser products under 21 CFR Part 1040.10 and 1040.11.

  • Key understanding: The FDA does not issue a "certificate". After review and approval, it issues an Accession Number, which is the core credential for customs clearance and sales.

2. Mandatory Compliance Steps

  • Laser classification: Determine the Class based on output power, wavelength, and pulse characteristics. Industrial welding machines typically fall into Class 4, requiring the strictest protection and labelling requirements.

  • Test report: An FDA-recognised laboratory issues a radiation safety test report in accordance with 21 CFR 1040.10 or IEC 60825‑1.

  • FDA registration: Submit Form 2877 Laser Product Report, complete establishment registration to obtain an FEI number, and obtain an Accession Number after product listing.

  • Labels and manuals: Must bear the compliance statement ("Complies with 21 CFR 1040.10"), laser class, warning markings, and English safety instructions.

3. Continuing Obligations (Easily Overlooked Compliance Risk Points)

  • Annual report: Submit between 1 September and 1 October each year.

  • Establishment annual fee: Renew between 1 October and 31 December each year.

  • Change notification: Notify the FDA within 30 working days when safety-related components such as the laser cavity, optical lenses, or protective housings are changed.

  • U.S. Agent: The FDA prioritises contact with the U.S. Agent during review and surveillance; absence will result in application rejection or blocked communication.

III. Laser Welding Machine Exports to the EU: Multi-Directive Coordination Under the CE Mark

1. Core Directive Framework

Laser welding machines entering the EU must simultaneously satisfy the following directives – none may be omitted:

  • Machinery Directive 2006/42/EC (to be replaced by the EU Machinery Regulation (EU) 2023/1230 from 20 January 2027).

  • Low Voltage Directive (LVD) and Electromagnetic Compatibility Directive (EMC).

  • RoHS Directive (restriction of hazardous substances).

2. Core Laser Safety Standard: EN 60825‑1

  • The current effective version is EN 60825‑1:2014+A11:2021, mandatory since 21 June 2023.

  • Role: Determines the laser class and specifies the engineering control measures that Class 4 equipment must be equipped with – protective housings and interlocks, remote interlock connectors, key control, beam stops, and emission indicator devices.

  • Note: Compliance with EN 60825‑1 alone is not sufficient to obtain the CE mark; it is only proof of the laser safety dimension.

3. Machinery Safety Specific Standards: EN ISO 11553 Series

  • EN ISO 11553‑1: General safety requirements for fixed laser processing machinery (including welding machines), covering complete machine risk assessment, protective housing performance, and control system safety (requiring compliance with the ISO 13849 functional safety standard).

  • Core logic: Even if the internal laser is Class 4, through complete machine enclosure protection and interlock design, the radiation level accessible to operators during normal use can be reduced to the Class 1 safety level.

  • EN ISO 11553‑3: Noise hazard measurement and noise reduction requirements, directly supporting the essential health and safety requirements of the Machinery Directive.

4. Conformity Assessment Pathway

  • Class 4 laser welding machines are high-risk equipment and typically cannot rely on self-declaration alone. An EU Notified Body must be involved in EC type examination, and the CE mark may only be affixed after obtaining the certificate.

  • Technical documentation must be retained for at least 10 years for inspection by EU market surveillance authorities.

IV. Core Differences and Common Misunderstandings Between U.S. and EU Certification for Laser Welding Machines

DimensionUnited States (FDA)European Union (CE)
Regulatory natureRadiation safety registration system, no "certificate"Conformity assessment, Notified Body involvement
Core standards21 CFR 1040.10 (harmonised with IEC 60825‑1)EN 60825‑1 + EN ISO 11553
Continuing obligationsAnnual report + annual fee + change notificationTechnical documentation retention + market surveillance response

Common misunderstandings:

  • Mistaking FDA registration for "FDA certification" and neglecting annual maintenance, leading to registration suspension and cargo detention.

  • Assuming that EN 60825‑1 testing alone allows the CE mark to be affixed, omitting the complete machine safety requirements of the Machinery Directive and EN ISO 11553.

  • Submitting an outdated version of an IEC 60825‑1 test report to the FDA – old standard versions may not be recognised.

V. Summary and Recommendations for Laser Welding Machine Exports to the U.S. and EU

Core recommendation: Manufacturers should incorporate both regions‘ compliance requirements simultaneously at the product design stage – on the U.S. side, lock in the laser class and establish an annual compliance calendar; on the EU side, use EN ISO 11553‑1 as the framework to integrate complete machine safety design. It is recommended to prioritise testing bodies that simultaneously hold FDA-recognised qualifications and EU Notified Body authorisation partnerships, completing basic testing in one go and submitting applications to both regions separately to control time and cost.
