1、 What is the 'Non Dual Use Item Report'
It should be noted that the "Non Dual Use Item Report" is not a statutory form issued by the Ministry of Commerce or Customs, but a technical judgment document prepared by export operators themselves (or commissioned by third-party testing agencies) to prove that their goods do not fall within the scope of dual-use item export control. Its function in practice is to submit the customs declaration documents and prove to the customs, agents, and customs brokers that the batch of laser marking machines does not meet the technical parameter red line of the "Dual use Item Export Control List", and export does not require the application of a dual-use item export license.
Its compliance basis comes from the Export Control Law and the Regulations on the Export Control of Dual Use Items (implemented on December 1, 2024): export operators should identify whether the goods belong to the control scope before customs declaration, and follow the principle of "parameter unique judgment" - as long as the objective technical indicators touch the red line of the list, they are subject to control, regardless of the nominal use; Items with parameters that do not meet the standards are considered non controlled items and do not require a license. The Regulation also stipulates that if it is indeed impossible to identify on its own, consultation can be sought from the Ministry of Commerce.
2、 Why does the laser marking machine need this report in particular
According to Announcement No. 77 of the General Administration of Customs in 2026, starting from June 30, 2026, processing equipment such as laser marking machines, laser cutting machines, and laser welding machines under export tax numbers 8454-8465 must be verified for their involvement in dual-use item control throughout the entire process of procurement, receipt, and customs declaration; If the product elements, purposes, parameters, and functional information are unclear, the customs will directly reject the order. Suspected goods may also be subject to analysis, manual inspection, or even technical appraisal, with a processing time of 1-3 months.
Therefore, for export enterprises, a non dual-use item report with clear parameters and sufficient basis has become a "standard" document for smooth customs clearance of laser marking machines.
3、 Judgment logic: Exclude item by item from the checklist
The laser marking machine is mainly excluded from the "Dual Use Item Export Control List" (Announcement No. 51 of 2024) from two dimensions:
Laser dimension (Class 6 "Sensors and lasers", with the core being the 6A205 laser clause). The lasers regulated by this clause have clear performance thresholds, for example: neodymium doped lasers must be pulse excited and Q-switched, with a pulse width of not less than 1ns, and a single transverse mode average power greater than 40W (multiple transverse modes greater than 50W); Pulsed carbon dioxide lasers must have a repetition rate greater than 250Hz, an average power greater than 500W, and a pulse width less than 200ns. The laser of ordinary fiber optic marking machines (commonly 20W-100W, with pulse width and average power far below the threshold) and CO ₂ marking machines usually do not meet the above conditions and do not fall within the range of 6A205.
Machine dimension (Class 2 "Material Processing", with the core being the 2B201 Precision Machine Tool clause). The precision machine tools regulated by this clause are limited by indicators such as positioning accuracy (the current standard is about measuring positioning accuracy at the micrometer level according to ISO 230-2), while the positioning accuracy of ordinary laser marking machines is generally in the tens to hundreds of micrometers range, which usually does not meet the controlled conditions.
As long as both types of parameters do not touch the red line, the conclusion can be drawn that 'non dual-use items do not require an export license'.
4、 The core content typically included in a report
A non dual-use item report that can be used in practice generally includes:
Product basic information: name, model, serial number, quantity, manufacturer
Customs classification: Product number (usually classified under 8456 as "processing machine tools for various materials using laser processing", such as 845611090, etc.)
Complete technical parameters: laser type, wavelength, output power, pulse width, repetition rate, marking format, positioning accuracy, number of control axes, protection level, etc
Comparative analysis item by item: Compare the above parameters with the technical thresholds of the relevant provisions of the "Dual Use Item Export Control List" (such as 6A205, 2B201) one by one, and explain why they do not meet the requirements
Third party testing data: actual testing reports issued by qualified testing institutions as support for the authenticity of parameters
Conclusion and Commitment: Clearly declare that the product does not belong to dual-use items, export does not require a license, and the export operator is responsible for the authenticity of the parameters
5、 Handling process and precautions
Basic process: Product parameter measurement (can be entrusted to a third-party laboratory) → Comparison list item by item analysis → Preparation of report (issued by the enterprise itself or commissioned by a testing agency) → Submission of customs declaration documents such as contract, invoice, packing list to customs/freight forwarder for pre-approval → Normal export declaration.
Notes:
Model consistency is key. The models and parameters listed in the report must be completely consistent with the customs declaration and the actual product; When the parameters change due to laser replacement or firmware upgrade, the report needs to be updated synchronously.
The parameter information must be clear and complete. Information ambiguity is the primary reason for customs returns and initiation of analysis, and it is essential to provide complete data such as positioning accuracy, number of control axes, laser parameters, etc.
Keep the original records. It is recommended to keep test reports, design documents, etc. for at least a few years for later verification by customs or commercial authorities.
The fallback clause cannot be ignored. Even if the parameters are not controlled, if one "knows or should know" that the goods may be used for purposes that endanger national security, weapons of mass destruction, or terrorism, they must still actively apply for permission from the Ministry of Commerce; If there is a change in the end user or end use, the export should be immediately stopped and reported.
6、 Violation risk
The cost of illegal export control items is high: those with illegal business operations exceeding 500000 yuan can be fined 5-10 times; For amounts less than 500000 yuan, a fine of 500000 to 5 million yuan shall be imposed (Article 39 of the Regulations), and in serious cases, criminal responsibility may also be pursued; And the accountability covers the entire chain of entities such as factories, foreign trade companies, freight forwarders, and customs brokers, with no exempt parties.
Summary: For enterprises exporting laser marking machines, the "Non Dual Use Item Report" is essentially a set of technical compliance documents consisting of "parameter self certification+list comparison+commitment statement". Its value lies in allowing customs to quickly confirm that the goods are not subject to dual-use item control during the declaration process, avoiding returns and judgments, and ensuring timely customs clearance. When compiling, the measured parameters should be used as the basis, the list terms should be used as the ruler, and the consistency between the model and the actual product should be maintained.
