In 2024, China’s export volume of laser equipment reached 614,900 units, and U.S. imports stood at 220,100 units, accounting for one-third of China’s total exports. These statistics demonstrate strong U.S. market reliance on Chinese-manufactured laser cutters.
However, market opportunities come with an unavoidable compliance threshold: FDA certification. Laser cutters fall under radiation-emitting electronic products and are subject to mandatory regulation under 21 CFR 1040.10. Products without valid certification face risks including customs detention, fines and legal litigation.

Laser cutters are high-power laser devices. The vast majority of industrial laser cutters feature laser output power exceeding 500 mW and are classified by the FDA as Class IV (highest hazard class).
The core regulatory objective of FDA oversight is to verify whether laser radiation emissions remain within safe limits, safety protective devices function properly, and product labeling and user manuals satisfy regulatory requirements.
Only after completing laboratory testing and FDA registration to obtain an Accession Number can products clear U.S. customs and be listed for sale on e-commerce platforms.

Per regulations issued by the FDA Center for Devices and Radiological Health (CDRH), laser cutters must satisfy the following compliance criteria:
Complete FDA laser product registration and obtain an official Accession Number
Provide radiation safety test reports complying with FDA standards to verify radiation leakage stays within legal thresholds
Affix FDA-specified laser classification labels and safety warning marks on equipment, accompanied by English safety operation manuals
Appoint a U.S. Agent (mandatory for non-U.S. enterprises)
Submit annual reports regularly to update product information and sales data
FDA certification for laser cutters consists of two core phases: laboratory testing and official registration.Step 1 Confirm Product ClassificationNon-medical laser cutters only require enterprise registration and product reports. If intended for medical applications, a 510(k) premarket notification submission is mandatory.
Step 2 Prepare Technical DocumentationRequired materials include laser wavelength, output power specifications, product structural drawings, safety design descriptions (safety interlocks, key switches, emission indicators, etc.), samples of laser classification labels and user manuals.
Step 3 Sample Submission and Laboratory TestingDeliver prototypes to an accredited laser testing laboratory for safety testing in accordance with 21 CFR 1040.10. Test items cover:
Radiation safety testing: laser power, wavelength, beam divergence and other parameters
Verification of safety interlocks, emergency stop mechanisms, protective enclosures and other hardware
Compliance review of labels and instruction manuals On-site testing by engineers can be arranged for large-scale equipment.
Step 4 Issuance of Test ReportThe laboratory analyzes test data and releases an official test report.
Step 5 Submit FDA RegistrationUpload product reports and enterprise registration information via the official FDA electronic submission portal (FURLS / CDRH Portal). Starting in 2026, the FDA requires all laser product reports to adopt structured data formats.
Step 6 Obtain Market Access EligibilityUpon successful FDA review, product information is entered into the federal database for radiation-emitting electronic products, and an official Accession Number is issued.
Standard FDA certification for laser products takes approximately two weeks. Key factors affecting turnaround include:

Whether manufacturers complete preliminary safety assessments at third-party laboratories
Annual Maintenance Note: FDA registration requires annual renewal. Enterprises must complete renewal and information updates between July 1 and September 1 each year. Note that alternative sources reference September 1 to October 1 as the submission window. Failure to submit updates on time will invalidate the Accession Number and remove the product from the FDA database.

New rules effective December 1, 2024 clarify that high-power continuous-wave industrial lasers for cutting and welding are generally not controlled items. However, strict restrictions apply to equipment with advanced technical parameters, and manufacturers must verify controlled item status in advance.
Previous cases exist where enterprises received customs penalties due to undeclared germanium laser focusing lenses. Manufacturers must verify whether their products fall within the Catalogue of Dual-Use Items and Technologies Subject to Export Control and apply for export licenses ahead of shipment when applicable.
