1、 First, clarify the regulatory path: registration of radiation electronic products, not medical device approval
Laser cleaning machines are used for industrial rust removal, paint removal, and stain removal. The vast majority of them belong to the FDA's "Radiation Emitting Electronic Products" regulatory category and are managed by the Center for Devices and Radiological Health (CDRH). They follow the registration and product reporting path and do not require 510 (k) review.
Only when the product claims to be used for medical purposes such as human tissue processing, it belongs to medical devices (usually Class II, requiring 510 (k)). This must be strictly controlled in product manuals and promotional materials. Once the usage description goes beyond the boundaries, the regulatory path will be completely changed.
2、 Core regulatory basis
Mainly applicable to the 21 CFR Part 1000-1050 series:
21 CFR 1040.10: Performance Standards for Laser Products (General Requirements), applicable to all laser products manufactured after August 1, 1976
21 CFR 1040.11: Supplementary Requirements for Specific Purpose Laser Products
21 CFR 1002: Electronic Product Reporting Requirements (Product Reports, Supplementary Reports, Annual Reports)
21 CFR 1010: General Requirements for Electronic Products
3、 Laser Notice 56: A Key Practical Shortcut
The FDA issued Laser Notice 56 in 2019, declaring acceptance of classification and labeling according to IEC 60825-1, replacing the classification labeling requirements in 21 CFR 1040.10 that differ significantly from IEC. This means that if your machine already has a CE certified IEC 60825-1 test report, you can directly use the same classification and labeling system without having to redo it according to the US system. In practice, non US manufacturers usually declare in combination with "21 CFR 1040.10+Laser Notice 56".
4、 Safety level determination
Laser cleaning machines have high power (commonly several hundred watt pulsed fiber lasers), almost all of which belong to Class IIIb or Class IV. The level determination needs to be based on whole machine testing, considering output power, pulse characteristics, wavelength, achievable emission limit (AEL), etc. Class IV products must be equipped with complete safety measures: remote interlocking interface, beam termination/attenuator, protective cover interlocking, emission indication, English warning label, etc.
5、 Materials to be prepared before registration
According to the requirements of the FDA Product Report (Form FDA 3632 Guidelines), it mainly includes:
Manufacturer Information: Name, Address, Contact Information
Product information: Name, model, laser medium or emission wavelength, expected use
Technical documents: complete circuit diagram, optical path diagram, structural diagram/explosion diagram
Test report: It is recommended to be issued by an ISO/IEC 17025 accredited laboratory in accordance with 21 CFR 1040.10/IEC 60825-1, taking into account the reporting timeliness requirements
Labels and instructions: laser level identification, warning language, safety interlock instructions, must be in English
Quality system description: Production control that proves the product can continuously meet radiation safety standards
6、 Registration process
The overall cycle is usually 2-4 weeks, with the following steps:
Factory/Enterprise Registration: Establish an enterprise account in FDA's FURLS/Industry Systems system
Product testing and grading: Determine wavelength and power, complete safety level determination (about 2-3 days) and full testing (about 5-7 days)
Prepare Product Report: can be submitted electronically through FDA eSubmitter
Submit and obtain Attachment Number: Assign login number after FDA acceptance
Customs filing: Provide the Accession Number to the customs broker upon import, which is a necessary document for customs clearance of the goods
7、 Three essential cognitive points to know
Attachment Number ≠ FDA approval. It is only a confirmation number received by the FDA and entered into the database, and does not represent that the product has undergone safety review. Therefore, this is a post regulatory model of "submission is compliance", and the FDA reserves the right to conduct spot checks and request rectification (non-compliance may trigger notification and recall obligations under 21 CFR Part 1003/2004).
The annual report is a continuous obligation. Every year, sales quantity, quality control data, safety complaints, and other information must be provided to the United States (with a statistical period from July 1 of the previous year to June 30 of the current year). Failure to report on time may result in registration invalidation.
Design changes require a supplementary report to be submitted. Adding new models, modifying laser sources, and changing designs that affect radiation emission all require submitting a Supplement Report to update the original Attachment Number.
8、 Common risk reminders
Misuse of medical use statements in label instructions may drag the product into the medical device pathway
Replacing whole machine certification with laser module certification - FDA requires whole machine test reports
Only doing 'enterprise registration' without submitting a product report, the product is still considered non compliant
Lack of safety measures for Class IV machines (such as interlocking being bypassed) may result in non-compliance with performance standards and result in closure
If listed on Amazon at the same time, laser products will also be included in the mandatory DV verification control scope of the platform from 2026, and need to be prepared in advance
9、 Suggestion
If the enterprise already has an IEC 60825-1 complete machine report and English technical documents, the entire registration can be completed through the FDA electronic system on its own; If there is a lack of testing conditions or unfamiliarity with the itemized requirements of 21 CFR 1040, it is recommended to entrust institutions with laser product testing capabilities and FDA declaration experience to assist. The main value is to avoid repeated corrections and delays in customs clearance due to errors in report details with the FDA.
