Laser flashlight listed on Amazon US site compliance guide

2026-09-23 Industry News

1、 First, clarify the regulatory logic

Laser flashlights belong to the category of "laser+illumination" composite products, which must meet two sets of requirements simultaneously: the illumination part must comply with electrical safety standards (such as UL 153), and the laser part is regulated by the US FDA CDRH, applicable to 21 CFR 1040.10 and 1040.11 regulations. All laser products must complete FDA reporting before being put on the shelves. In addition, in April 2026, Amazon introduced a special compliance policy for laser products. Starting from May 22, non compliant ASINs will be uniformly and forcibly taken down, and in severe cases, store performance will be deducted. Therefore, now is the stage where entry must comply, not "sell first and then replenish".

2、 Power rating determines whether you can sell

The FDA classifies lasers into Class I to Class IV based on their hazards:

Class I (<0.39mW): Low risk, basic labeling and reporting are sufficient

Class II (0.39-1mW): Common laser indication levels

Class IIIa (1-5mW): Amazon's upper limit for ordinary laser indication products is 5mW

Class IIIb and Class IV (>5mW): Amazon explicitly prohibits the sale of such products without FDA authorization, and in practice, laser pens and handheld laser products are no longer accepted for application

Conclusion: Your laser module must be controlled within Class IIIa (≤ 5mW), which is the lifeline of whether it can be put on the shelves.

3、 List of Essential Compliance Documents

Before listing, it is necessary to submit through the seller's backend or designated email:

The FDA Laser Product Report and Access Number are the "entry tickets" for laser products

Complete machine testing reports issued by ISO 17025 accredited laboratories within the past 12 months, based on 21 CFR 1040.10 full item testing - note that IEC 60825-1 reports cannot be replaced, and FDA does not directly recognize EU standards; And it must be a complete machine report, only the qualified report of the laser module or component is invalid

Product label, outer packaging, and instruction manual samples

Manufacturer's Declaration of Conformity

In 2026, a DV (Direct Validation) mechanism will be added: the platform will designate a third-party organization to verify the authenticity of your report. PS reports or the use of old reports will be basically detected, and ASINs that fail verification will be directly banned from sale.

4、 Requirements for labels and instructions

The permanent label on the product casing must include:

Warning and signal words (DANGER/CAUTION) and warning symbols

Laser grade identification, such as "CLASS IIIa Laser Product"

Output power and wavelength

Manufacturer name and address

Declaration of Conformity: "Complies with 21 CFR 1040.10"

The instruction manual should include safety operation guidelines and potential hazard explanations.

5、 Listing page specification

The detail page must clearly indicate the laser hazard level and human accessible output power (in watts)

Do not claim to exceed the IIIa emission limit, and do not use borderline terms such as "high power laser" or "burning laser"

If the product is also a lighting flashlight, it is recommended to prepare a UL 153 test report for the lighting section to avoid being randomly selected and taken down as a "portable light fixture"

Laser products with children's toy attributes are limited to Class I (≤ 1mW) only. If your product is not a toy, do not use words such as "toy" or "for kids" in the title and description to avoid triggering stricter children's product reviews

6、 Application process and cycle

The entire closed-loop process takes approximately 2-4 weeks: product pre evaluation and grading (2-3 days) → ISO 17025 laboratory comprehensive testing (5-7 days) → organizing technical documents and submitting them to the FDA through the FURLS system (5-10 days) → obtaining an Accession Number. The cost includes testing fees, FDA registration/US agency annual fees (with designated US agents), and DV verification service fees, with higher fees for products exceeding the standard.
