Laser Export to the U.S.: FDA Certification Process, Timeline, and Compliance Guide

The U.S. market has strong demand for lasers, but market access requirements are also rising. In addition to FDA regulatory requirements, some high‑performance lasers are subject to dual‑use export controls. Companies must simultaneously address product safety compliance and trade control challenges. As technological competition between China and the U.S. intensifies, compliance requirements for laser exports to the U.S. are becoming increasingly stringent. Planning a compliance path in advance is essential.


II. Core Requirements for FDA Certification of Laser Exports to the U.S.

It is important to clarify that the U.S. FDA does not issue any physical “certificate” for laser products. Instead, it implements a mandatory registration + testing compliance system, regulated by the FDA‘s Center for Devices and Radiological Health (CDRH). Laser exports to the U.S. must comply with 21 CFR 1040.10 (Laser Product Performance Standards) and 21 CFR 1040.11 (Requirements for specific‑purpose laser products). The only proof accepted by U.S. Customs and FDA inspections is the Accession Number and associated technical documentation – not a so‑called “FDA certificate” issued by a third‑party body.


III. Complete FDA Certification Process (Four Steps)

Step 1: Product testing and laser classification
Send the laser to an accredited laboratory for full testing in accordance with 21 CFR 1040.10. Core indicators include output power, wavelength, beam divergence angle, and radiation levels. Based on the results, the laser class (Class I to Class IV) is determined, and a compliant Laser Radiation Safety Test Report is issued. The FDA classifies laser products into four classes; Class IIIb/IV high‑risk lasers (such as industrial cutters and medical aesthetic lasers) have the strictest protection and labelling requirements.

Step 2: Appoint a U.S. Authorised Representative
Non‑U.S. manufacturers must appoint an agent located within the United States to receive FDA notifications, assist with communications, and handle emergency contacts.

Step 3: Prepare technical documentation
Prepare English‑language user manuals, circuit diagrams/optical path diagrams, bills of materials (BOM), label samples, production flow charts, and quality control documents.

Step 4: Submit registration and product report
Complete establishment registration (obtain FEI number) and product listing through the FDA FURLS system, and submit the product report. Upon FDA review and approval, a unique Accession Number is issued. Medical‑use lasers also require additional 510(k) or PMA approvals.

Required for import customs clearance: All laser products entering the U.S. must be accompanied by FDA Form 2877 (Import Declaration for Electronic Products Subject to Radiation Control Standards), with three copies placed on the outer packaging.


IV. FDA Certification Timeline

With complete documentation, the overall FDA registration cycle for lasers is approximately 2‑4 weeks, including product testing and FDA registration. Some low‑risk products can be completed in as little as 1‑2 weeks. It is recommended that manufacturers prepare product testing and documentation in advance to avoid delays caused by incomplete documentation.


V. Dual‑Use Export Control Considerations

Some high‑performance lasers may fall under the Catalogue of Dual‑Use Items Subject to Export Control of the People‘s Republic of China. For example, target‑designating lasers specially designed for unmanned aerial vehicles – if their technical specifications simultaneously meet control thresholds (such as energy >80 mJ, beam divergence angle <0.3 mrad, etc.) – are controlled items and require an export licence. Companies can apply for a consultation letter through the Ministry of Commerce’s unified business system platform to confirm whether their products fall under the controlled scope.
